  2. the problem is nationwide. Creating the illusion that men are pedophiles is a pre-planned action by law enforcement and because of that, the conspiracy theory thrives. How far up the ladder are those who are responsible for this happening? Obviously Judd has nothing to do with this particular case, so we have some higher ranking members in the DOJ who must be aware of this. This is scary to think.

    2. i'm not one to pre-judge, but I know for fact that he unfairly prosecuted some sting cases. In one case the kid almost went to prison when there was plenty of evidence proving he was interested in "a womans touch". I understand he is just doing his job, but hopefully he will be of assistance to us. I would definitely welcome that and I am hoping he replies to our email. We have actually established a good rapport with many attorneys throughout the state so I am looking at this as more of a positive thing for now.

  6. I just wanted to also let people know that I am now inquiring about any civil claim I might have. I obviously cannot get into any details, but we are kind of charting new territory here. Not too many attorneys have been so willing to even consider such a case, but...........I am now very optimistic about things. Win your criminal case! That is all i can say about that, lol.

    1. we can only hope. We have the data, we've provided the facts, and we have done a pretty good job of assimilating it all which culminated in this article I put together. Facts don't lie, law enforcement does!. One thing to note, it is apparent that law enforcement all over the country is being trained to use tactics like, "bring a teddy bear, condoms, milk", etc. What this tells us is that this problem is coming from someone up the chain of command unless Judd and Co. have been able to spread the word. Whoever is instructing LEO's to use such tactics and/or is allowing this to occur needs to be sought out! In order to do so, legislators need to read this article for sure. We need to start some kind of buzz within communitie

  18. some good news in a case out of St. Johns. A judge granted a belated appeal in a sting related case and it looks as if he might be granted an appellate bond in time for the holidays. That is awesome! It seems as if belated appeal is a way for an appellate bond as well. I did not ever consider this.

  20. The time has come where we are at the root of the sting problem!

    "Perverted Justice" and "To Catch A Predator" showed this country how to set up innocent men to look like child predators. Thanks to Lewis Conrandt's sister clearing his name, the show was shut down because of entrapment. This was not before law enforcement agencies throughout the country picked up the illegal tactics. Despite the DOJ spending millions of dollars a year since 1998 to train law enforcement properly on how to catch real child predators, law enforcement still use their own "in house training" and ignore the training they are supposed to be getting that is paid for by taxpayer dollars.

    We have started this decade with cases like Grizzle and Aguirre stating that tactics like these are illegal. Now we are at the ROOT OF THE PROBLEM with the TX circuit court of appeals stating that "dirty talk" with a minor IS PROTECTED SPEECH. This is the root of the problem because law enforcement agencies in the state of FL and elsewhere have declared that the reason they encourage the commission of crimes is because of "illegal communication" with alleged minors!

    I have said it once and I will say it a thousand times: THERE IS NO SUCH THING AS AN ILLEGAL CONVERSATION. Law enforcement are using the freedom of speech rights against the "targets" who are already "talking dirty" in the first place to encourage the commission of crimes. Crimes that would not exist had it not been for the constitutional violations in the first place! THIS CONSTITUTES INDUCEMENT!

But something I really want you to realize is some people don't give a damn what law enforcement did, some people feel like law enforcement should be able to do ANY and everything possible to catch "predators", some people believe there should be no such thing as entrapment in these types of cases, some people just like to be assholes and that we can't change those peoples mind's no matter what.   31. EVERYONE should read this! This indirectly explains why these cases rarely go federal. Apparently, if there is no intent to persuade a minor to have sex then the person has not violated federal law. The only thing criminalized in federal law is the intent to persuade. Therefore, since the way they perform the stings here in FL and elsewhere is by trying to persuade the target to have sex then there is no federal case or at most not a strong one. This should make the entrapment argument that much more compelling! There is also good federal case law in there as well and it is a good guide for a defense attorney.

      or even by making some plans or some preparation for the commission of a crime. The
      difference between conduct which violates the law and conduct which does not violate the law,
      in this regard, is what is referred to as ‘a substantial step’ towards the commission of a crime.”).
      It is therefore not speech that is criminalized, but the intended result, which in this case is “to
      persuade minors to participate in illegal sexual acts.” Bailey, 228 F.3d at 639; see also United
      States v. Dhingra, 371 F.3d 557, 561-63 (9th Cir. 2004) (rejecting overbreadth challenge because
      statute regulates conduct—inducement of minors for sexual activity—not speech).

      Therefore, simply talking about sex, agreeing to have sex, agreeing to meet to have sex, and even driving to the predetermined meeting place at the predetermined time to allegedly have sex ARE ALL NOT ILLEGAL WHEN NONE OF IT IS YOUR IDEA! The communication MUST show that it was YOUR INTENT to persuade a minor to have sex with you and not that the "minor" was looking for your consent or trying to persuade you. THIS IS WHY THE FIRST AMENDMENT ARGUMENT IS SO IMPORTANT!

      These stings are not performed to catch child predators like they are supposed to be doing. These stings are designed to MAKE THEM or at minimum the appearance of one. All of the articles that you read about the alleged statements made by the "suspect" during the online communication, while disgusting or distasteful they may be, ARE NOT ILLEGAL AND PROTECTED SPEECH because it was the undercover officer that planned, solicited, and encouraged the "target" to carry out some act (including speech) just to arrest them.

    2. That's right people, we are at a point in history where law enforcement are using immoral conduct to create the appearance of a crime in violation of the US constitution!

      Putting the lies that the media tells for law enforcement to the side, now does everyone see how these stings work so well? Too often are immoral acts confused with illegal ones. Too often has the constitution been ignored to "protect the citizens". Too often has the meaning of the constitution been altered by the government in search of a hidden agenda like money in this case.

      The constitution is not just a collection of inalienable human rights! That is just what the constitution has. However, what the constitution IS is a declaration that we are, in fact, human and we need those rights in place so that we can exercise that right to be human! Without the rights enumerated in the constitution, the right to be human is taken away. The constitution says that WE ARE ONLY HUMAN and these are the things we NEED to be human.

      All of the men that have ever been arrested in one of these illegal stings are only human too. It is human nature to be persuaded into something immoral specifically when you are already engaged in the immoral activity of looking for sex online with a complete stranger. It is human nature to say something immoral and out of character when the other "person" you are talking to is ostensibly doing the same thing and encouraging you.

      The time has come for simple minded fools like "law enforcement" to stop exploiting a CONSTITUTIONALLY PROTECTED "only human mistake" that was only made because THEY CREATED THE WHOLE SCENARIO IN THE FIRST PLACE. No wonder a lot of law enforcement officials believe the constitution does not exist. It is because if it didn't exist then their job would become trivial and they would not have to do anything but arrest people they felt were weird, creepy, perverted, or just because they did not like them.

  41. we need to finish up these stings, i found this one from a sting that somebody did, but never finished it. We can only pray there are not any more, but I wouldn't be surprised if there are more. We have more suicides than successful entrapment cases. This is a topic for media. This is the only way to expose this problem. I have sent emails out to every single reporter I have worked with, but sometimes emails do not work so I need to figure something else out. There is no reason why media should not want to report on this.

    2. My son was caught in Orange County spider web sting. This is his first offense, he was 21 given 5 year probation. It has been nightmare, ever since. The only thing that gives me some hope is reading the comments in this site. I sent my son Lawyer the appeal case link http://opinions.1dca.org/written/opinions2013/09-13-2013/12-3407.pdf

      to see if we would be able to appeal but his answer was that it was a good case but the difference is that the government has prior communications between my son and and undercover agent.

Now the FSC should be able to proceed.......i don't know the exact issues that they are raising, but there were 3 issues on appeal they were fighting. All it does is eliminate that one charge which is sentenced concurrently with other charges. It's the other issues, soliciting, objective entrapment, that will be of the most help to everyone. in my opinion

    1. hey i just wanted you all to know i did 20 months at marion illinois federal penitentiary. i was the very first person in the craigslist case in 2008. then they prosecuted me again in georgia for the same crime, the state. there is no double jeopardy

    2. these things are out of control, i got on craigslist in 08, then the north georgia crimes against children taskforce posted an add on casual encounters saying they were looking for no strings attatched fun. wfm 18. i responded and they later said they were just turning 15. i drove 10 miles down the road to meet them and never got out of my truck and was bombarded by police. i pled guilty in federal court in 09 in chattanooga, tn. i got a below guideline sentence by chief federal judge curtis collier. he said my case was outside the heartland of these cases and warranted a below guidline sentence. did you know the enticement charge carries a mandatory minimum 10 years in federal prison. they dismissed that charge if i agreed to plead to a lesser offense. then the damn guys indicted me in state court right after i pled guilty for the same crime. they didnt give me any more time just ran concurrently. but still i am constantly surveillenced by state and federal probation officers its a nightmare

      New Mexico and Virginia enacted statutes that criminalized the dissemination of non-obscene but sexually explicit material to minors over the internet, but federal courts held those statutes unconstitutionally overbroad under Reno because they unconstitutionally burdened otherwise protected speech...

      The government “cannot constitutionally premise legislation on the desirability of controlling a person’s private thoughts.” First Amendment freedoms are most in danger when the government seeks to control thought or to justify its laws for that impermissible end.         United States v. Gladish, 536 F.3d 646, 649 (7th Cir.2008)

        Because Goetzke and his intended victim had a prior relationship, his effort to lure the victim back to Montana for sex could not be thought idle chatter. But the fact that the defendant in the present case said to a stranger whom he thought a young girl things like "ill suck your titties" and "ill kiss your inner thighs" and "ill let ya suck me and learn about how to do that," while not "harmless banter," did not indicate that he would travel to northern Indiana to do these things to her in person; nor did he invite her to meet him in southern Indiana or elsewhere. His talk and his sending her a video of himself masturbating (the basis of his unchallenged conviction for violating 18 U.S.C. § 1470) are equally consistent with his having intended to obtain sexual satisfaction vicariously. There is no indication that he has ever had sex with an underage girl. Indeed, since she furnished no proof of her age, he could not have been sure and may indeed have doubted that she was a girl, or even a woman. He may have thought (this is common in Internet relationships) that they were both enacting a fantasy.

        We are surprised that the government prosecuted him under section 2422(b). Treating speech (even obscene speech) as the "substantial step" would abolish any requirement of a substantial step. It would imply that if X says to Y, "I'm planning to rob a bank," X has committed the crime of attempted bank robbery, even though X says such things often and never acts. The requirement of proving a substantial step serves to distinguish people who pose real threats from those who are all hot air; in the case of Gladish, hot air is all the record shows. So he is entitled to an acquittal on the section 2422(b) count, the effect of which will be to reduce his sentence from 13 years to 10 years.

        We add, because it bears on our analysis of the attempt issue, that the district judge should not have prevented the psychologist whom the defendant had hired as an expert witness to testify with respect to the attempt. The expert's report states that the defendant seeks sexual gratification in Internet chat rooms and in watching pornographic films because he has a "character pathology" that has produced "a pervasive interpersonal apprehensiveness with the expectation that others will reject and disparage him." The defendant explained to the psychologist that he uses the Internet to gratify his sexual desires because "it's safer and less expensive—it's a cheap date and I don't have to worry about all the sexually transmitted diseases." The expert's report says that "such a response underscores the emotional and physical distance he prefers in his adult interpersonal relationships due to pronounced fear of ridicule and rejection." This was support for the "hot air" hypothesis of Gladish's conduct.

      4. OH YES BUT IT DOES! That's why that case cited other cases throughout the country. The way the "tier system" works from bottom to top in the judiciary branch of government is state laws, state constitution, federal laws, and then federal constitution.

        The federal constitution is the law of the land and if we have law enforcement in the state of Florida (or any other state) using the first amendment against someone to encourage them to commit a crime because the conversations are considered illegal then that S*** just wont fly. Sure it might be considered persuasive precedent at this point but we already have a Florida case essentially stating the same thing:


        Jeffery L. Cashatt v. State of Florida, 873 So. 2d 430 (2004)

        …sexually oriented communication on a computer on-line service which is viewed by a child is not a violation of the statute unless the sender of the communication “knowingly” attempts by the communication to seduce the child.

        AGAIN, LAW ENFORCEMENT CANNOT POSE AS A PROMISCUOUS TEEN AND THE CONVERSATIONS USED TO INDUCE THE COMMISSION OF CRIMES IS PROTECTED SPEECH. The Cashatt case as well as other FL cases proving objective entrapment can be used with the two cases above to prove to the court that these tactics violate the federal constitution which ultimately trickles down to the state constitution! THIS IS THE DESIRED RESULT THE CONSTITUTION REQUIRES!

    9. On November 26 My good friend will be having a Motion to dismiss, motion to suppress hearing. This is a NON-Traveler case (online chat only). His lawyers are arguing entrapment based an lack of predisposition. The motion to suppress is based on Jurisdiction issues involving the Tallahassee Police as well as the Air Force Office of Special Investigations. (Please look up the Posse Comatatus act). Basically the police are not allowed to ask the Air Force for help in civilian matters. There is also a motion to compel, because during the last motion the cop lied and also did not have answers to simple questions. (who actually arrested the defendant?)

      If you all would like to observe this motion hearing that could be rather explosive, please come to the Leon County courthouse in Tallahassee and come to courtroom 3D at 10am on November 26th. Hope to see you there and hope that My buddy gets alot of support from all of you.

So he pushed for states to have mandatory 25 years to life in prison for first time offense.     33. Have you guys noticed that all the case law that could AUTOMATICALLY get entrapment cases dropped have been abolished. Cruz, Casper, Banks, possibly Lusby. Seems like legislators back then didn't like so many cases getting dropped so easily.

      Now with Lusby it was during the "Cruz days" and we all know that was abolished. But the judge was basically stating that this country doesn't condone random virtue testing. BUT then again from what I gather anything before Munoz they tossed those cases out like they never happened and can't be used apparently, so I plan on TRYING to use it but we'll see how that goes...I'd much rather have another Florida case or even supreme court case that talks about random virtue testing, and I've tried looking it up but all I come up with is Canadian cases (which by the way they don't play when it comes to entrapment, the first question asked when a defendant raises an entrapment defense there is "was the defendant engaged in criminal activity"...smart country) obviously different from our shitty ass laws. So if anyone knows of another virtue testing case please fill us in.

You know first hand that it's not easy to get people to listen and get on our side, so therefore we need to force them on our side. I truly believe a rally is our "big break", and a great idea. I'm sorry I'm I sound like I'm coming off a little strong, please don't take it the wrong way I'm just baffled as to why it hasn't been done yet, when it WILL bring attention to this important cause...

I really believe there are only two ways to achieve real change and relief from these "stings": 1) Challenge the constitutionality of these operations by appealing cases to the FL Supreme Court, and ultimately to the U.S. Supreme Court if necessary. Of course this is expensive unless an attorney can be found who will champion the cause for little or no fee (perhaps an attorney for the ACLU), or 2) Lobby the FL Legislature, since after all they are largely responsible due to the wording of the statutes. Maybe the formation of a PAC is needed.

      There are some of the known legislators that we have had contact with. I would like to start keeping track of who files any complaint and to whom, Just report this info like on a weekly basis....or even better, ill create a log where you can just enter the info. That'll make is easier for everyone This will give me a rough indication on how concerned people are as well so please spread the word. You can also include comments made on blogs, etc and i will include a "website" column. I should have something ready in a day or two. I know there are a few of us who put a god awful lot of time into these stings and I don't expect anybody to do that, but it would be nice to see things documented that way I can see how things are progressing, etc.

Let me tell you my case was going on until now they said 2 pics on my work computers flag as cp and is not i just had some woman pics clearly not underage. Now they try to scare me not to go with the motion to dismiss because of this. They want to add another charge.. But u know what bring it on, im innocent and i will fight you until the end.     60. I think those stats can and should be used in court! They certainly prove the creation of crime and therefore objective entrapment. Their sole defense for these stings is lying about the men arrested and that they do them all the time. The stats prove they are lying and they should have never started the stings getting rid of their lame ass excuses!

Well I see people are just standing in line just waiting to make a comment on the ACLU Florida facebook page.......i just hope to God that this isn't an indicator of change because if it is, we would be making as much progress as a snail crawling in "reverse". When I post a link to a blog and ask others to jump in, then that is our "online" rally that allows us to express our opinions. Strength is in numbers and right now I am feeling pretty darn weak.

      1. we are doing that and the 3.850 motion. I have email the Governor, the supreme court, the President, The firs lady, and all the state representatives, the senators as well. I still think we should all think about putting our money together get a lawyer willing to really fight for us and represent us all of us not just a few of us and take it to court I think that would bring attention even more especially if all 697 families would do it.

I don't really know and yes it would be better if it was a group of attorneys and with all the people that are involved with these proceedings (how much more efficient it would be all of us standing together in a court room imagine that for a minute) if everyone could agree to come up with a set amount each family would be able to bring to the table even if some of them couldn't bring as much as the others because this has caused such a hardship on most of the families as it is already. If we truly had an amount of money we could show the group of lawyers then maybe they would take it. The only downfall is it leaves the door open for the state to do more of these stings just to get done what I am suggesting because that is even more money out of our pockets but it is just a suggestion. I am at my wits end because I have done all I know and helped all I can I am at a standstill. My husband is doing the 3.850 because we were ignorant of the law and didn't know what we were doing at the first of all this if we could of had all this wonderful information that Talknstang and Due Process along with countless others helped to get we probably wouldn't be where we are but winning instead of losing 3.5 years of his life for these stings.

Talknstand the reason why so many people are not commenting on the fb page is because in order to do it your real identity get expose and im sure many people are having this situation within direct family only. Commenting on another fb page will appear on their fb and friends and family can see the post. I bet a lot of people wants to have privacy related to this to contain the public damage as much as they can. I sure everyone here wants to help as much as they can. We just need to get the attention on a powerfull person and that will turn this problem a 180 degree. We just need to get to that person or institution that is willing to hear us. On the fb page you can create sort of a background with info on these stings something that the public can read and says wow is increible!!..
